🎨 Terms of Service — Digital Art Commissions

Ko-Fi Waitlist:
By paying a $1 fee on Ko-fi (on the “Commission Waitlist”), you reserve a “base commission” slot when commissions open. Provide an active email and commission details. If accepted, the full process continues via PayPal invoice under Standard Terms for “Base Commissions”. Refunds are given if request is denied. Slots are limited, so please reply promptly when contacted.
Ko-Fi Commissions:
By paying the Ko-Fi commission, you agree to (Magz) the artist’s Terms of Service. 100% is paid upfront. Delivery estimated within 1 week, unless stated otherwise. No refunds once digital goods are sent. Ko-Fi commissions are for personal use only. No NSFW or discriminatory content allowed for commission. Only “simpler” and cheaper art commissions are available on Ko-Fi.
Base Commissions (PayPal Invoice):
By paying the invoice, you agree to (Magz) the artist’s Terms of Service. 50% is paid upfront for service, 50% is paid upon delivery of digital goods. No refunds once work begins. Delivery estimated within 3 weeks unless stated otherwise. Base commission is for personal and limited commercial use. No NSFW or discriminatory content allowed for commission. Fees for: Major revisions (after the 1st time), and Wider Commercial Use.
By commissioning art from magz (magzanilla), the client (“you”) agrees to the following Terms of Service. Please read these terms carefully before submitting payment or confirming a commission request. These terms apply to PayPal invoices, Ko-Fi, and commissions arranged through e-Mail / Direct Messaging.
Commissioning a piece means you acknowledge and agree to these terms in full.
- Commissions begin only after the client has confirmed their decision and the initial payment has been received.
- Refunds are not permitted after the service has been completed and the digital files have been delivered.
- Once the commission has begun, refunds are not available except in the following cases:
- The artist has not started the work.
- The artist determines they cannot complete the commission for personal or technical reasons.
- Payment Structure:
- $1 waitlisting fee - to request a “base commission” slot through Ko-Fi. The commission is not started until commissions are open, and the process is confirmed.
- Payment Structure:
- 100% upfront - to cover the final good(s) and process. The digital files are delivered via Ko-Fi direct message.
- Payment Structure:
- 50% upfront – to cover the service portion of the work, including research, correspondence, sketching, and concept development.
- 50% upon completion – to receive the final good(s), including high-resolution digital files via email (and optionally via direct message).
Unless otherwise stated in written correspondence or invoice notes, Base commissions are generally delivered within three (3) weeks. Ko-Fi commissions are generally delivered within one (1) week. Ko-Fi Waitlisting does not start the commission process, until commissions are open.
- If delays occur (due to health, workload, or unforeseen events), the artist will notify the client promptly.
- Final artwork is delivered digitally in high-resolution* format via email.
*(unless “low resolution” is aesthetically intended, like in pixel artwork)
- The client is not guaranteed to receive work-in-progress (WIP) updates, since the commissions are intended as a simpler, faster, and affordable option.
- Minor changes (e.g., color tweaks, small adjustments) are included.
- Major revisions - such as changing poses, characters, composition, or overall theme—requested are not included.
- The client will receive work-in-progress (WIP) updates at key stages (for example: sketch, base colors, final render).
- The client is encouraged to give timely feedback at each stage.
- Minor changes (e.g., color tweaks, small adjustments) are included.
- Major revisions - such as changing poses, characters, composition, or overall theme—requested after the artwork is near completion may incur an extra revision fee after the first major revision.
- The client will be informed of options available and of the fee, before any revision fees are charged.
The artist reserves the right to refuse or decline any commission request for any reason, including but not limited to:
- Health or scheduling limitations,
- Inability to complete the request to standard,
- Limited commission slots,
- Violation of these Terms of Service,
- Or simply personal discretion (“not wanting to”).
The artist will not create content that is:
- NSFW / sexually explicit,
- Discriminatory or hateful toward any group or individual,
- In violation of PayPal’s Acceptable Use Policy, or
- In violation of relevant international anti-discrimination or equality laws.
Commissions are delivered for personal use by default. Examples of personal use include:
- Displaying the artwork on social media (with credit to magz / magzanilla),
- Using the artwork as an avatar, banner, or wallpaper,
- Printing it for personal display.
For “base commissions”, Limited commercial use may be permitted with written approval from the artist. Examples of limited commercial use include:
- Promotional art for a small business or stream,
- Art used in monetized videos or music covers (with credit).
For “base commissions”, wider commercial use such as merchandising, product packaging, or mass reproduction - a commercial license fee will be required, to be discussed and agreed upon before the project begins.
In most cases, proper credit is required, such as “Art by magz (magzanilla.com).”
- Before work starts: Full refund possible.
- After work starts but before delivery: No refunds unless the artist cancels.
- After delivery: No refunds under any circumstances, as digital goods cannot be returned.
- If the artist (Magz) cancels the project, a full or partial refund will be provided depending on progress.
- Clear and respectful communication is expected from both parties.
- The artist (Magz) will keep the client informed of progress.
- Clients are encouraged to provide feedback within a reasonable timeframe to prevent unnecessary delays.
The artist welcomes reviews, testimonials, and permission to share completed artwork (with credit). If a client prefers the piece to remain private, they may request that it not be shared publicly.
By sending payment or confirming a commission, the client acknowledges that they have read, understood, and agreed to these Terms of Service.
